Question: If I record a cover of a song can I upload it?

Answer: NO. The person who wrote the song owns that copyright. Unless you have their permission you cannot upload the song.


Question: We are an unsigned band and want to post a song we wrote and recorded ourselves. Is this ok?


Answer: YES. Unless you have transferred the copyright to someone else, you own the copyright and may post it to your MySpace page. Contact MySpace about setting up an official band page for your band.


Question: Can I post content from a television episode or a motion picture?

Answer: NO. These works are protected by copyright and may only be distributed by the copyright owner or by someone who has express permission from the copyright owner (such as an official publicist or agent).


Question: Can I post a home video?

Answer: YES. If you created a wholly original video, you may post it to MySpace.


Question: Can I dub a copyrighted song into my home video that I want to upload to MySpace?

Answer: GENERALLY NO. If you include someone else's copyrighted song in your video without authorization, it may cause your video to be blocked at the request of the copyright owner by MySpace's content filter. If your original video is blocked or removed from your profile and it has a song in the background, and you do not have a license from the copyright owner to use that song, we suggest you remove the song and re-upload the video to MySpace


Question: Can I post a song to MySpace if I bought the CD?


Answer: NO. Owning the CD and owning the copyright in the songs on the CD are not the same thing. You own your CD but you do not own the copyright in the songs on the CD. Therefore, you may not post the songs to MySpace. If you would like to show support for a musical group or artist, we suggest you create a fan club in MySpace "Groups".

The MySpace Terms and Conditions prohibit you from posting material that you do not have the necessary rights to post.
